Terms of Service

Welcome to Clocked Golf. These Terms of Service (“Terms”) govern your use of the Clocked Golf mobile application and website (collectively, the “Service”) operated by Civiswings Golf LLC (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use Clocked Golf. By using the Service, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts of users who misrepresent their age.

2. Account Registration

To use Clocked Golf, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to refuse registration or cancel accounts at our discretion.

3. Acceptable Use

You agree not to:

• Submit false or misleading round data to manipulate leaderboards
• Use automated tools, bots, or scripts to access the Service
• Attempt to circumvent security measures or access others’ accounts
• Harass, abuse, or harm other users
• Post offensive, defamatory, or inappropriate content
• Use the Service for any illegal purpose
• Attempt to reverse engineer or copy any portion of the Service

4. Betting and Wagering Features

By using the betting and wagering features, you acknowledge and agree that:

• All money settlement between players happens entirely outside of the Clocked Golf app
• You are solely responsible for ensuring that any wagering activities comply with the laws of your jurisdiction
• Clocked Golf bears no responsibility for any financial disputes between users
• Some jurisdictions prohibit wagering even between friends — you are responsible for knowing and following your local laws
• These features are intended for recreational use among consenting adults

5. Clocked Score and Leaderboards

Your Clocked Score is calculated based on round data you submit. By submitting round data, you represent that it is accurate to the best of your knowledge. We reserve the right to remove or flag rounds that appear fraudulent or inconsistent with normal play.

Leaderboard rankings are for entertainment purposes. We make no warranties regarding the accuracy or fairness of rankings.

6. User Content

By submitting content to Clocked Golf (including round data, profile information, and activity feed posts), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating the Service.

You represent that you own or have the right to submit all content you provide, and that such content does not violate the rights of any third party.

7. Intellectual Property

The Clocked Golf name, logo, Clocked Score methodology, and all app content are the intellectual property of Civiswings Golf LLC. You may not use, copy, or reproduce any of our intellectual property without prior written permission.

8. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

Clocked Scores, handicap estimates, and course statistics are provided for informational and entertainment purposes only. They are not official golf handicaps and should not be used for official tournament play.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIVISWINGS GOLF LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $10 IF YOU HAVE NOT PAID ANYTHING).

11. Indemnification

You agree to indemnify and hold harmless Civiswings Golf LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third party rights.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, suspected fraud, or any other reason at our discretion. You may delete your account at any time through the app Settings or by contacting us.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Palm Beach County, Florida.
